Govt. Of India Issues Final Notice To Twitter For Compliance With New IT Rules

by RTD Journal

The Union Ministry of Electronics and Information Technology has sent a final notice to Twitter for failing to comply with the new IT laws, and has once again warned to take legal action if the US-based social media network fails to do so.

The ministry’s warning stated that “consequences will follow” as a result of Twitter Inc’s non-compliance with the guidelines, which came into effect on May 26, 2021.

“However, as a gesture of goodwill, Twitter Inc is hereby given one final notice to comply with the rules, failing which the exemption from liability available under section 79 of the IT Act, 2000 shall stand withdrawn and Twitter shall be liable for consequences as per the IT Act and other penal laws of India,” it stated.

The ministry stated that it is obvious from the company’s reply that it has not notified about the Chief Compliance Officer’s information as required by the rules. It further stated that the platform’s nominated Resident Grievance Officer and Nodal Contact Person are not its employees in India, as required by the new laws.

“You claimed that Twitter Inc’s office address is that of an Indian law firm, which is also against the guidelines.”

It said that Twitter’s unwillingness to comply reflects the company’s lack of dedication and effort in ensuring a secure environment for Indians on its platform.
